Terms and conditions
The following Terms and Conditions apply to Willa pod Orłem, hereinafter referred to as the Property.
The owner of the Property is Anna Dobrowolska, NIP 6792766369, REGON 120428245, Tuwima 3/6, 34,500 Zakopane.
Persons staying at the Property are hereinafter referred to as Guests.
The person making the reservation at the Property and paying for the reservation is hereinafter referred to as the Booking Person.
I Basic information
1. Making a reservation constitutes confirmation that the Guest has read these Terms and Conditions, accepts them, and agrees to comply with their provisions.
2. Guests staying at the Property are also required to comply with health and safety regulations and fire safety regulations and, in exceptional situations, to follow the instructions of the Property staff.
3. In the event of a violation of these Terms and Conditions, the Property has the right to refuse further services to Guests who violate them. Such persons are obliged to immediately comply with the requests of the Property staff, settle payments for services already provided, pay for any damage or destruction caused, and immediately leave the Property premises.
4. By making a reservation, the Booking Person agrees to the processing of personal data solely for the purpose of completing the reservation and fulfilling the registration obligation in accordance with the provisions of the Act of 29.08.1997 on the Protection of Personal Data. The Booking Person has the right to access and update their personal data.
5. Reservations are made in the name of the person or company that will make the payment.
6. Only persons registered at the Property are entitled to use the Property. The Guest may not transfer the rented room or apartment to other persons, even if the period for which the fee has been paid has not yet expired.
7. Due to fire safety regulations, the use of open flames in rooms and apartments and their surroundings is prohibited. The use of heaters and other electrical devices not belonging to the apartment equipment is also prohibited. This prohibition does not apply to chargers and power supplies for electronic and computer devices.
8. The Guest bears full financial and legal responsibility for any damage or destruction of items, furnishings, and equipment of the apartment caused by the Guest or their visitors. The basis for financial compensation for damage or destruction is the price list available upon request.
9. If any discrepancies between the inventory list and the actual condition or any damage are noticed, this must be reported to the reception immediately upon occupying the apartment or room. Otherwise it will be assumed that the equipment was complete and undamaged.
10. Guests are particularly obliged to:
a. maintain order and cleanliness in the apartment or room and on the balcony or in the garden;
b. use the Property equipment in a manner that does not cause damage or deterioration.
11. The liability of the Property for loss or damage to items brought by Guests into the apartment is governed by Articles 846 to 849 of the Civil Code.
12. The apartment or room is inspected by a staff member before check in and after check out.
13. Check in time starts at 15:00 and check out time ends at 11:00.
14. Check in after 20:00 and check out before 8:00 must be reported in advance and agreed with the Reception.
15. Smoking and walking in ski boots are strictly prohibited on the Property premises.
16. Quiet hours apply from 22:00 to 7:00.
17. Guests using apartments and rooms must behave in such a way that during quiet hours they do not disturb other Guests in any way, and during the day their behavior must comply with social norms and respect the right of other persons staying at the Property to rest.
18. The Property has the right to terminate the Agreement with immediate effect without refund if the Guest or persons staying in the apartment violate the Terms and Conditions, behave aggressively, or disturb the peace of third parties, including residents of neighboring apartments, especially by organizing parties or other gatherings that violate social norms and good conduct. If intervention by the Police, Municipal Guard, security services, or a Property employee is required, the Property will charge the Guest an additional fee of 1000 PLN for each violation. This does not limit the possibility of claiming compensation under general legal provisions.
19. If the Property determines a violation of the Terms and Conditions, receives complaints from neighbors, building administration, or the Police, or in the event of non payment for the stay, the Property is entitled to enter the apartment after attempting to notify the Guest by phone beforehand.
20. Unregistered persons may stay in the apartment or room between 7:00 and 22:00.
21. The presence of unregistered persons in the apartment after 22:00 is considered consent by the Booking Person for paid accommodation of those persons. The accommodation of each additional person will be charged according to the extra bed price from the price list.
22. Children and minors under 18 may stay only under the supervision of adults who assume full responsibility for their behavior and any consequences.
23. Reservations and stays by minors aged between 13 and 18 are possible only with written consent of a legal guardian sent by email. If during check in or during the stay it is determined that the Booking Person is a minor, the Reception will immediately contact the legal guardians to confirm whether they approve the Agreement. They will have 3 hours to provide confirmation. If confirmation is not received, the Agreement will be considered not concluded.
24. The Property reserves the right to refuse accommodation to persons visibly under the influence of alcohol or drugs or behaving in a vulgar manner.
25. Waste segregation is mandatory in the apartments in accordance with local municipal regulations. If waste is not segregated correctly, the Property may charge an additional fee of 100 PLN.
26. For the comfort of all Guests, pets are not allowed. Violation of this rule will result in a financial penalty. Stays with pets are possible in Apartamenty pod Orłem. Detailed information is available at the Reception.
27. Hotel rooms are equipped with an electricity management system based on room cards. The cards issued at the reception must be inserted into the electricity switch when entering the room. Loss of the card results in a one time fee of 30 PLN.
28. The Property is not responsible for items left in the apartment or room after check out.
29. The Property is not responsible for utility failures, power, water, or heating outages, equipment malfunctions, or other events beyond the control of the Property, including administrative actions or natural disasters.
30. Guests are prohibited from using electrical outlets to charge electric vehicles.
II Additional fees
1. The price of the stay does not include the local city tax collected during check in and transferred to the municipal authority, or other additional fees.
2. Payment for the stay and the local tax of 2 PLN per person per night are collected on the day of arrival at check in.
3. One child up to 3 years old per two adults stays free of charge if sleeping in the existing bed.
III Online reservations
1. Online reservations can be made via the website www.willapodorlem.pl
2. To confirm a reservation the Booking Person must pay 40 percent of the total reservation value for the standard offer, 50 percent for Christmas or New Year’s Eve bookings, or 100 percent for the non refundable offer within 48 hours of making the reservation or within one hour if the reservation begins the same day.
3. For selected stays including the period from 20 December to 3 January, full payment for the stay must be made 14 days before arrival. In case of cancellation the payment is non refundable. Failure to pay the remaining balance on time will result in cancellation of the reservation and the deposit will not be refunded or transferred to another date.
4. For reservations made on the day of arrival the deposit equals 100 percent of the reservation value.
5. Payments are made via the PayU payment system available in the booking panel or by traditional bank transfer.
6. The same cancellation and complaint rules apply to online reservations as to reservations made by other methods.
IV Changes to reservations
1. Payment of the deposit constitutes acceptance of the reservation conditions defined in these Terms and Conditions.
2. Failure to pay the deposit within the agreed time results in cancellation of the reservation.
3. Cancellation. If a confirmed reservation is cancelled the prepaid amount is retained by Anna Dobrowolska.
4. Change of date. Changing the stay date after paying the deposit is possible only once and must be done at least 14 days before the planned arrival date. The change may be made only once for the same property at the same price while maintaining the original length of stay. If the new date falls in a higher season the price difference must be paid. The deposit must be used within 90 days from the original check in date.
5. In case of no show without cancellation the deposit is non refundable and cannot be used for another reservation.
6. Extension of stay. The stay may be extended if the property is available. The Reception must be informed by phone or email to arrange payment for the additional night.
7. Transfer of rights. The client may transfer all rights arising from the reservation to another person provided that the new person accepts all obligations resulting from the reservation. The Reception must be notified immediately.
V Voucher
1. The voucher can be used within 12 months from the date of purchase. After this period it is considered used.
2. The voucher can be used only once and requires prior reservation with the voucher number.
3. Please contact the Reception in advance by phone or email quoting the voucher number to confirm availability.
4. The printed voucher must be handed to the reception upon arrival.
5. Conditions for change or cancellation are defined in the Terms and Conditions of Willa pod Orłem where the reservation was made.
6. The voucher has no cash value and cannot be refunded or exchanged for cash.
The voucher may be used only once and cannot be divided.
VI Complaint procedure
1. Guests have the right to submit complaints regarding services provided by the Property.
2. The Property accepts complaints only by email sent to kontakt@willapodorlem.pl within 14 days from the end of the stay or, if the stay did not take place on the booked date, within 14 days from the date the stay was planned.
3. The Property reserves 14 days to review the complaint and inform the Guest of the result.
VII Additional information
1. Guests have access to free unguarded parking. Parking is allowed only in designated areas. The Property owner is not responsible for vehicles or items left in them.
2. Free WiFi Internet is available throughout the Property. The Property is not responsible for interruptions in internet access or for the actions of guests online.
3. The Property is monitored.
SPA zone regulations
1. For safety reasons it is strictly forbidden for persons under 18 years of age to use the SPA zone without the supervision of an adult.
2. Children under 3 years of age are not recommended to use the sauna.
3. Persons staying in the SPA zone are required to maintain order and cleanliness and follow safety rules.
4. These regulations are valid from 01.07.2019 until further notice.
5. Persons using the sauna declare that they are fully able to use such facilities and take full responsibility for their health condition.
6. In case of feeling unwell the sauna or jacuzzi should be left immediately.
7. The sauna is not recommended for:
a. persons with heart disease or circulatory system disorders
b. persons with acute respiratory infections or asthma conditions
c. persons with fever
d. persons abusing pharmaceutical substances
e. persons immediately after intense physical effort
f. women during menstruation or pregnancy
8. In the SPA zone it is forbidden to:
a. stay under the influence of alcohol or other intoxicating substances
b. enter the sauna or jacuzzi wearing clothes or shoes
c. bring food, glass items, alcoholic beverages, tobacco or other intoxicating substances
d. independently regulate temperature or humidity
9. Before entering the sauna or jacuzzi it is required to:
a. remove all metal items to avoid burns
b. remove glasses or contact lenses
c. wash the entire body with soap under the shower and dry it
d. remove footwear, the sauna must be entered barefoot
10. In the sauna room guests must lie or sit on a dry towel so that no part of the body touches the wooden surface.
11. Guests are required to completely remove from the body all lotions, oils, and makeup. Failure to comply with this rule and contamination of the water will result in a full water replacement and the Guest will be charged the related cost of 500 PLN.
12. In case of flooding the SPA area the Guest will be charged 140 PLN.
13. After using the sauna it is not recommended to use the jacuzzi basin and physical effort is not recommended. Entry is at the Guest’s own responsibility.
14. After using the sauna the entire body must be washed thoroughly under the shower.
15. Jumping into the jacuzzi is strictly prohibited.
16. The Guest must report any irregularities in water cleanliness or technical issues of the jacuzzi within 5 minutes of entering.
17. Only children who no longer wear diapers are allowed to enter the SPA.
18. For children up to 10 years old a fee of 20 PLN per hour is charged.
